No person shall be held to answer for a capital, or otherwise infamous crime, unless on a presentment or indictment of a Grand Jury, EXCEPT in cases arising in the land or naval forces, or in the Militia, when in actual service in TIME OF WAR or public danger;

as I read this amendment it says a person in the military will be subject to the military's rules. This doesnot seem to be relating to other citizens, noncitizens, POWs, or enemy combatants. I base this on the precedent to your last emphasis : WHEN IN ACTUAL SERVICE.

I'd also like your take on the fact that teh amendment opens up with the phrase NO PERSON and then goes on to list the exception for soldiers (ours). would this not indicate that the amendment applies to all regardless of citizenship?
